Move to decriminalise abortion in New South Wales voted down

A proposal to decriminalise abortion has been voted down in the New South Wales parliament.


Greens MP Mehreen Faruqi’s abortion law reform bill was defeated 25 to 14 in the state parliament’s upper house on Thursday. Public members in the gallery shouted “shame” as the result of the conscience vote was announced in the state’s legislative council.


The defeat means that abortion will remain an offence in the NSW Crimes Act, and unlawfully procuring abortion will continue to be punishable by up to 10 years’ imprisonment under the act.


Unlawfully supplying a drug or instrument for an abortion will also continue to be punishable by up to five years’ imprisonment.


Abortions in NSW are currently made legal by an interpretation of the Crimes Act by the NSW district court in 1971.


That interpretation, known as the Levine ruling, allows doctors to approve an abortion if a woman’s physical or mental health is in danger, and taking into account social, economic or other medical factors.


Proponents of reform said the current situation created considerable uncertainty for doctors and women, stigmatised abortion, and was archaic.


But the Catholic church mobilised in opposition to Faruqi’s bill, led by Sydney archbishop, Anthony Fisher.


“Archbishop Fisher has asked all Catholics in Sydney and others of goodwill to defend life by giving a voice to unborn and signing a petition to the NSW members of parliament,” a statement on the archdiocese’s website said last month.


The Greens’ bill had the support of the Royal Australian and New Zealand College of Obstetricians and Gynaecologists, Australian Lawyers for Human Rights, the NSW Council for Civil Liberties, Marie Stopes, Family Planning NSW and many other groups.


The ACT has decriminalised abortion completely and Tasmania and Victoria have also successfully pursued abortion law reform.


But similar attempts in Queensland ran into difficulty and were delayed earlier this year, following opposition from the state’s Liberal National party.

New South Wales police asked to investigate fake doctor

NSW police have been asked to investigate a man who allegedly stole a doctor’s identity and managed to remain employed for more than a decade at four of the state’s hospitals.


Shyam Acharya has already been charged by the Australia Health Practitioners Regulatory Authority but NSW Health Minister Brad Hazzard says the maximum $ 30,000 penalty is woefully inadequate.


He has asked police commissioner Andrew Scipione to pursue the case after previously leaving it to federal authorities.


Hazzard said a police investigation could help NSW Health’s efforts to seize Acharya’s North Ryde house, estimated to be worth at least $ 1.25 million, in order to recoup his wages.


“There is a possibility that if this person were convicted of fraud, we may be able to get some of the money back under the proceeds of crime legislation,” Hazzard told reporters on Saturday afternoon. However, he said seizing the home could be complicated because another person, possibly Acharya’s wife, was on the title.


Hazzard also confirmed plans for an independent inquiry into how Acharya was allegedly able to “con the entire health system”. Acharya is said to have posed as Dr Sarang Chitale by entering Australia on a fake passport and gaining registration with the Medical Board of NSW.


He worked in hospitals at Manly, Hornsby, Gosford and Wyong while the real doctor practised as a specialist in the UK. Acharya is now on the run and believed to have fled overseas.


Labor’s health spokesman Walt Secord is backing efforts to seize the Acharya’s house and has given in-principle support to an independent investigation. “The community has a right to know if his activity led to clinical errors,” he said in a statement. “Thousands of patients and their families have question marks over their treatment.”


Since allegations about Acharya became public less than a week ago, Hazzard said about 30 people had called NSW Health believing they had been treated by him.


Twenty-six were either mistaken or had been treated by Acharya but had suffered no adverse affects as a result. The remaining four cases are still being investigated.


“The health department has indicated to me at this point that there doesn’t appear to be any serious concerns, but certainly we’ve got to look at everyone,” Hazzard said.

Self-harm by children rises steeply in England and Wales

Nearly 19,000 children and young people were treated in hospital in England and Wales after self-harming in the last year, a figure that has risen steeply in recent years, according to a leading children’s charity.


The National Society for the Prevention of Cruelty to Children (NSPCC), which collected the data from hospitals using freedom of information requests, says the rise of 14% over the last three years – an extra 2,400 cases – is worrying. A growing number of hospital beds are being filled by children who have taken violent and drastic steps to alleviate their emotional pain and suffering, says the charity.


The children most likely to harm themselves are aged 13 to 17 and tend to be struggling to cope with the pressures of modern life, the charity warned.


Childline, run by the NSPCC, also delivered 50 counselling sessions a day in the last year to children and young people about self-harm. The charity is appealing for funds, saying it can deal with only three out of every four young people who call the free hotline.


One 14-year-old boy who contacted Childline said: “Sometimes I get flashbacks from what happened when I was younger and I cope with the horrible memories by cutting myself. School helped take my mind off things but now that the holidays are here I’m struggling. My parents always seem to be too busy for me and I don’t want to tell my friends what happened. I feel so miserable and lonely – can you please help?”


A 14-year-old girl told counsellors: “Recently I’ve lost some people that were really close to me. When I started to self-harm it seemed to mask the emotional pain I was feeling, even if it only helped for a little while. When I get the urge, I can’t seem to stop it until it’s done; otherwise I get really upset and angry. A couple of times I’ve gone too far and ended up in hospital.”


Peter Wanless, chief executive of the NSPCC, said: “A frightening number of children and teenagers are being driven to self-harm as a way of dealing with unresolved feelings, tensions and distress in their lives.


“Knowing hospital beds are full of young people crying out for help should be a real wake-up call to all those [who] care for the wellbeing of the younger generation. It is vital we confront the fact that an increasing number are struggling to deal with the pressures and demands of modern-day life, to such an extent they are inflicting terrible damage upon themselves.”


Childline’s president, Dame Esther Rantzen, said it was deeply disturbing that children were ending up in hospital. “Self-harming is at epidemic level among young people: at Childline we hear from them every day.


“It has become one of the most common problems young people bring to us, and I know from our counsellors that these are some of the most painful stories we hear. Often the young people feel too ashamed and fearful to seek help from those around them, until they harm themselves so badly they have to be rushed to hospital.”


Dr Max Davie of the Royal College of Paediatrics and Child Health said the rise in the numbers was of real concern. “Whilst we don’t know what it was that brought all 19,000 children to self-harm, what we do know is that support was not offered early enough to prevent it from getting this serious. Early intervention is essential if we are to reduce the number of children self-harming and needing specialist mental health or emergency services.”


He called for comprehensive personal, health, social and economic (PHSE) teaching in all schools, which addresses a range of issues including eating disorders, self-harm and suicide, as well as positive relationships, sex education and the dangers of drugs and alcohol abuse.


“There are a lot of pressures on children. It is not easy being a child these days,” said Dr Jon Goldin, a consultant child and adolescent psychiatrist and spokesman for the Royal College of Psychiatrists. “In some ways children are encouraged to grow up too fast.”


He cited the sexualisation of children in the media and the pressure of social media on children and adolescents to look good and as if they are having a good time, when the reality might be different. Cyberbullying is a problem and schools are focusing intensely on academic work and examinations. Children need also to learn about relationships and emotional wellbeing. “I think schools need permission from government to see that as part of their remit,” he said.


Economic and social factors affecting families are also part of it. “Young people are a kind of canary in the mine, drawing attention to other social problems,” he said. Sadly, he felt young people were not always optimistic about the future of themselves or their world and he said that they need their often-very-busy parents and others to find time to listen to them and help them understand their own distress.


Sarah Brennan, chief executive of YoungMinds, said the rise in self-harm was extremely worrying and called for early intervention. “We know from our research that young people face a huge range of pressures, including stress at school, college or university, body image issues, bullying on and offline, around-the-clock social media and uncertain job prospects. Difficult experiences in childhood – including bereavement, domestic violence or neglect – can also have a serious impact on mental health, often several years down the line.


“As a society, we need to do far more to prevent mental health problems from developing in the first place. To start with, we urgently need to rebalance our education system, so that schools are encouraged to prioritise wellbeing and not just exam results.”

More than 100 people have killed themselves in prisons in England and Wales so far this year, , according to penal reform groups, prompting warnings of a mental health epidemic within the incarcerated population.

No one should be so desperate while in the care of the state that they take their own life and yet, every three days, a family is told that a loved one has died behind bars.


“By taking bold but sensible action to reduce the number of people in prison, we can save lives and prevent more people being swept away into deeper currents of crime and despair.”


The current rate of self-inflicted deaths in prisons across England and Wales of nearly 10 a month means the final toll for 2016 could be as high as 115, compared with 89 in 2015.


A joint report, Preventing Prison Suicide by the Howard League and the Centre for Mental Health, links the rise in the number of prison suicides to cuts to staffing and budgets and the rise in the number of people in prison that has resulted in overcrowding.]

“Violence has increased and safety has deteriorated. Prisoners are spending up to 23 hours a day locked in their cells, the imposition of prison punishments has increased and a more punitive daily regime was introduced in prisons at the same time as the number of deaths by suicide began to rise,” it says. “The prison suicide rate, at 120 deaths per 100,000 people, is about 10 times higher than the rate in the general population.”


The report calls for a recently revised incentives and earned privileges regime to be scrapped and for an undertaking that prisoners with mental health problems or at known risk of suicide should never be placed in solitary.


The Howard League’s figures show that the highest number of self-inflicted deaths – six – this year have been at Woodhill prison, Buckinghamshire, which is at the centre of a high court legal battle.


Mr Justice Lavender gave permission on Thursday for a judicial review case to be heard, saying that evidence of repeated failures to implement policies to prevent self-inflicted deaths at Woodhill could not be dismissed as “operational failures”.


It has also emerged that an independent monitoring board at Bedford prison, which has had four deaths so far this year, wrote “an urgent letter of concern” to the prisons minister about the “alarming rise in prisoners attempting to hang themselves” at the jail before its recent riot. They highlighted that staffing shortages were “beyond crisis point”.


An independent monitoring board report published on Monday into Bullingdon prison in Oxfordshire warns that inadequate staffing is also damaging morale and relationships with prisoners.


“The board is concerned about increasing difficulties in recruiting and retaining sufficient officers to maintain levels defined as acceptable by the prison service. It has also observed that indiscipline and violence have increased noticeably since staff cutbacks were implemented in 2013,” says the Bullingdon report.


The chancellor, Philip Hammond, confirmed in the autumn statement last week that an extra £555m over the next three years would be made available to fund prison safety measures, including the recruitment of 2,500 extra prison officers.


A Ministry of Justice spokesperson said that mental health in custody was taken extremely seriously: “Providing the right intervention and treatment is vital to improving the outcomes for people who are suffering and all prisons have established procedures in place to identify, manage and support people with mental health issues.


“But we recognise that more can be done. That is why have invested in specialist mental health training for prison officers, allocated more funding for prison safety and have launched a suicide and self-harm reduction project to address the increase in self-inflicted deaths and self-harm in our prisons.”

Among those aged 80 or over, dementia and Alzheimer’s accounted for 13.7% of male deaths and 21.2% of deaths among women.


Meanwhile, the mortality rate for dementia and Alzheimer’s has more than doubled over the past five years, the figures show.


But due to improvements in treatment, diagnosis and awareness, the mortality rates for the other top five leading causes of death – including ischaemic heart disease, chronic lower respiratory disease, lung cancer and cerebrovascular diseases such as strokes – have fallen since 2001.


The ONS data shows that for 2015, ischaemic heart disease was the second leading cause of death, accounting for 11.5% of deaths.


But when the figures are broken down by gender, they show that heart disease is still the leading cause of death for men and dementia and Alzheimer’s disease were certified as the main cause of death among women.


“In 2015, dementia and Alzheimer’s disease became the leading cause of death in part because people are simply living longer but also because of improved detection and diagnosis,” said Elizabeth McLaren, the head of life event statistics at the ONS.


The figures also show large variation among age groups – people over 80 were more likely to die from dementia and Alzheimer’s – while suicide was the leading cause of deaths for people aged under 35.


Meanwhile, breast cancer remains the leading cause of death for women, aged 35 to 49.


But when all forms of cancer are grouped together, cancer was the most common cause of death in 2015, accounting for 27.9% of all deaths.

Francine Bates, the chief executive of the Lullaby Trust, said: “Whilst it is extremely good news that Sids [sudden infant death syndrome] has gone down in England and Wales, evidence has shown that many more babies’ lives could be saved if all families had access to and followed safer sleep advice.


“It is very important that we work together to ensure safer sleep messages consistently reach all families, particularly those at increased risk such as young parents and families living in areas with higher Sids rates.”
